Right to Request Flexible Working

From 30th June 2014, under the Children and Families Act 2014 all employees with at least 26 weeks continuous service will have the right to request flexible working. The statutory procedure that employers currently follow when considering requests for flexible working will be replaced with a duty on employers to consider requests in a ‘reasonable’ manner.  ACAS has produced a new statutory Code of Practice along with guidance.              

New Health and Work Service

A new Health and Work Service originally due to be introduced in April will now be brought in gradually from October 2014.  The state-funded service will carry out occupational health assessments for employees who are absent through sickness for 4 weeks or more with the aim of getting employees back to work more quickly.  Employees will be referred by GPs or employers and the Health and Work service will provide advice to employers and employees.  In instances where an employee fails to engage with the service, further fit notes certifying sickness absence will not be issued and employees will lose their SSP.
